ShastaBeam Digital Millennium Copyright Act (DMCA) Policy
Overview
The Digital Millennium Copyright Act of 1998 (DMCA) is a United States law that limits the liability of Internet service providers for content transmitted or stored at the direction of users, provided specific procedures are followed.

As a Service Provider, ShastaBeam complies fully with the DMCA by maintaining a clear procedure for handling copyright infringement notifications and counter-notifications, and by designating an agent to receive such claims.
1. Policy on Copyright Infringement Claims
All original creative works — written, visual, audio, or otherwise — are protected under U.S. and international copyright law. Users of ShastaBeam’s services are expected to respect the intellectual property rights of others. Uploading, sharing, or distributing copyrighted materials without permission is prohibited.
When a valid claim of copyright infringement is received, ShastaBeam will remove or disable access to the identified material in accordance with the DMCA. Users may submit a counter-notification if they believe the claim was made in error.
2. How to Report a Claim of Infringement
If you believe that content hosted through ShastaBeam’s network infringes your copyright, you must submit a written DMCA notice to our Designated Agent containing all required information under 17 U.S.C. §512(c)(3)(A):

Signature — A physical or electronic signature of a person authorized to act on behalf of the copyright owner.

Identification of Work — Identification of the copyrighted work claimed to have been infringed.

Identification of Material — Information sufficient to locate the allegedly infringing material (e.g., exact URL, IP address, or other identifying details).

Contact Information — The complaining party’s name, address, telephone number, and valid email address.

Good Faith Statement — A statement that the complaining party has a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.

Accuracy and Authority Statement — A statement, under penalty of perjury, that the information provided is accurate and that the complaining party is authorized to act on behalf of the copyright owner.
Submission Guidelines
Your claim must include sufficient information to identify and locate the material in question, such as:

Exact URL(s) or IP address(es)

Date and time observed

Description of the specific content at issue
Claims that do not substantially comply with these requirements may not be processed.
After Receipt of a Valid Claim
Upon receiving a valid claim, ShastaBeam will remove or disable access to the identified material. We will notify the customer who posted the content and provide an opportunity to submit a counter-notification. ShastaBeam acts as a neutral intermediary under the DMCA and does not determine the merits of a claim. Section 512(f) of the DMCA provides penalties for knowingly submitting false infringement notices.
3. How to Submit a Counter-Notification
If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a DMCA counter-notification with our Designated Agent that includes the following (per 17 U.S.C. §512(g)(3)):

Signature — Your physical or electronic signature.

Identification of Removed Material — Identification of the material that was removed and its prior location.

Good Faith Statement — A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.

Contact and Jurisdiction — Your name, address, and telephone number, and a statement consenting to the jurisdiction of the Federal District Court for your location (or for ShastaBeam’s service area if outside the U.S.), and that you will accept service of process from the original complainant.
Once a valid counter-notification is received, ShastaBeam will forward it to the original claimant. Unless the claimant notifies us within 10–14 business days that they have filed legal action seeking to restrain restoration, the removed material may be restored.
